Highlighted [items] are details to fill in or confirm before this page goes live. Have a lawyer review the legal pages for your company and your plans for paid plans.
About these terms
These terms apply when you use the GPS4YOU PET app and website (the “service”), provided by [Company legal name, legal form], [Registered address, Poland], [NIP / KRS] (“we”). By creating or using an account you accept them. If you use the service for an organisation, you confirm you may bind it. If you do not agree, please do not use the service. Our Privacy Policy explains how we handle personal data.
Accounts and acceptable use
Accounts are created for you by us or by the provider of your tracker. Keep your sign-in details private, manage who you share a pet with, and tell us straight away if you think someone else has used your account. You are responsible for what happens under it.
You must not: break the law or other people's rights; upload malware or unlawful content; disrupt or reverse-engineer the service; bypass its security or usage limits; or access other people's accounts.
Tracking pets lawfully
Use the service to look after pets you own or are caring for with the owner's permission. It is not for tracking people. Owning a tracker does not by itself make it lawful to follow someone, so do not attach one to a person or another person's animal without the legal right and the necessary consent.
What the service does, and does not do
The service shows the position and status reported by your pet's GPS tracker, sends alerts and offers tools such as Safe Zones, Lost Pet Mode, Walks and Activity.
GPS is not perfect. Positions can be delayed, approximate or unavailable, for example indoors, under heavy cover, when the tracker's battery is low or when there is no mobile signal. Alerts depend on the tracker, mobile networks, push notification services and your phone's settings, so we cannot guarantee that every alert arrives or arrives on time. The service helps you look after your pet; it does not replace supervision, a secure garden, a collar tag or a microchip, and it is not an emergency service.
Family sharing
You can share a pet with other people. Owners decide each person's role and permissions and are responsible for who they invite. Anyone you share a pet with can see that pet's location and status.
Plans, billing and cancellation
[Describe plans, prices, billing period, trials, renewal and cancellation, or state that the service is currently included with your tracker.] Prices and taxes are shown before you buy. Purchases made through the App Store are handled by Apple. If a plan renews automatically, you can cancel before the next renewal and keep access until the paid period ends. Consumers keep their statutory right to withdraw; see our Refund Policy.
Your data
Your pet's photos and information remain yours. You allow us to store and process them to provide, secure and support the service, to follow your lawful instructions and to meet legal duties. Ask us for an export of your data before you close your account or end a plan, because access afterwards is not guaranteed. The app, website, logo and other content belong to us or our licensors; you get a personal, non-transferable licence to use the app for its intended purpose.
Suspension and termination
You can stop using the service at any time and delete your account in the app (see Account Deletion). We may suspend or close an account for serious or repeated breach of these terms, non-payment or a legal requirement, normally after telling you why and giving you time to fix it. We may act immediately where there is unlawful activity, a security threat or a risk of harm, and we lift restrictions once the problem is resolved. If we stop offering the service for reasons that are not your fault, we give notice where we can and refund any prepaid period you did not use.
Liability
Nothing in these terms limits liability that cannot be limited by law, including for intentional harm, gross negligence, or death or personal injury caused by negligence, or your rights as a consumer under mandatory law. Subject to that, we are liable to consumers for reasonably foreseeable loss caused by our breach or lack of reasonable care. For business customers, we are not liable for indirect loss or lost profit, and our total liability is limited to the fees paid in the 12 months before the event. We are not liable for a missing, delayed or inaccurate position, alert or notification caused by things outside our control. [lawyer to confirm wording]
Changes, law and complaints
We may update these terms for legal, security or service reasons and will give reasonable notice of material changes. Changes are not retroactive, and if a change harms a paid plan you may end it before the change applies. If part of these terms cannot be enforced, the rest still applies.
These terms are governed by Polish law, without removing the protection of mandatory consumer rules of the country where you live. Please contact us first at [support@gps4you-pet.pl] and we will answer within 14 days. You may also turn to Polish consumer bodies, such as UOKiK and municipal consumer ombudsmen, or to the courts that have jurisdiction.
